Dolphin Discovery wishes to bring to the attention of the public that in the matter in which the Executive Council of Anguilla had allowed an Appeal and overturned the Decision of the Minister of Lands who had granted to Dolphin Discovery the permission to operate its business at Sandy Point, that the Court as of 23rd September 2013 gave judgement in the matter.
The Court, having previously granted Dolphin Discovery an injunction against the Government of Anguilla, the Dolphin Discovery filed a Claim against the Government of Anguilla seeking the Court for Orders to strike down the Decision of the Government on the basis that the Decision was Unconstitutional and Procedurally Irregular.
The Government of Anguilla did not contest the Application and as such the Court granted Judgment in favour of Dolphin Discovery and have struck down the Decision of the Executive Council on the basis that the Decision was Unconstitutional and Procedurally Irregular and awarded Costs against the Government of Anguilla.
Dolphin Discovery Anguilla wishes to let the public know that they remain committed to contributing to the tourism product of Anguilla and to its People.
At the Hearing Dolphin Discovery was represented by Mrs Josephine A.G. Gumbs-Connor and Miss Yanique L. Stewart of J.A.G. GUMBS & Co and the Attorney General’s Chambers was represented by Mr Ivor Greene.
